Terms of Service

These Terms of Service are an agreement between you and Gaffey Nails & Spa, located at 1306 S Gaffey St Ste 104, San Pedro, CA 90731. If you do not agree with any part of them, do not use the website, our booking tools or our messaging program.

1Age Restriction

You must be at least 18 years of age to use this website, submit a form, book an appointment online or enroll in our SMS messaging program. By doing any of those things you confirm that you are 18 or older.

Clients under 18 are welcome to receive services in the salon when accompanied by a parent or legal guardian. In that case the accompanying adult books the appointment, provides the contact information, gives any consent required and is responsible for payment.

We do not knowingly enroll anyone under 18 in the SMS program. If we learn that a number belongs to a minor, we will remove it.

2SMS Program Description

Gaffey Nails & Spa operates an SMS messaging program under the program name Gaffey Nails & Spa Appointment and Promotional Messaging. Subscribers who opt in may receive the following message types:

• Appointment confirmations. Sent after a booking is made, confirming the service, date, time and technician.
• Appointment reminders. Sent ahead of your scheduled appointment.
• Schedule change notices. Sent when a technician becomes unavailable, when we are running behind or when the salon closes unexpectedly.
• Conversational replies. Responses to questions you text us about services, pricing or availability.
• Promotional messages. Seasonal offers, new service announcements and salon news, sent only to clients who opted in to promotional content.

Message frequency varies based on how often you book. Most subscribers receive between two and six messages per month. Consent to receive marketing messages is not a condition of purchasing any service.

3Opt-Out Instructions

You are in control of these messages at all times. Use these keywords in a reply to any message you receive from us:

• Reply STOP to cancel. You will receive one final message confirming that you have been unsubscribed, and after that we will stop texting you.
• Reply HELP for help. You will receive a message with our contact details. You can also call us at (310) 732-0619.
• Reply START to resubscribe if you previously opted out and want to receive messages again.

Opting out of text messages does not cancel any appointment you have already booked, and it does not stop us calling you about a scheduling problem.

4Message and Data Rates

Charges for messages sent or received are set by your mobile carrier and are your responsibility. Check your plan if you are unsure what messaging costs you.

5Carrier Liability Disclaimer

Carriers including T-Mobile, AT&T, Verizon and Sprint are not liable for delayed or undelivered messages. Neither we nor the mobile carriers guarantee that any message will be delivered, or delivered on time.

Delivery depends on your carrier, your device, your coverage and factors outside our control. Do not rely on a text message as your only record of an appointment. If a reminder does not arrive, your appointment still stands as booked.

8Cancellation Policy

We hold your chair and your technician's time, so late cancellations cost us a slot we could have given to someone else.

• Notice window. Please give us at least 24 hours notice to cancel or reschedule. Call (310) 732-0619 or reply to your confirmation text.
• Late cancellation. Cancelling with less than 24 hours notice may result in a fee of 50 percent of the booked service price, charged at your next visit.
• No-show. Not arriving and not calling may result in a fee equal to 50 percent of the booked service price. Repeat no-shows may be asked to prepay for future appointments.
• Late arrival. Arriving more than 15 minutes late may mean we shorten your service or reschedule you, depending on what is booked behind you.
• Deposits. Deposits taken for large parties, event bookings or long custom art sets are non-refundable if cancelled within 48 hours of the appointment.
• Our cancellations. If we have to cancel on you due to illness, equipment failure or an emergency closure, you owe nothing and we will prioritise rebooking you.

Services already performed are not refundable. If you are unhappy with a set, tell us within 7 days and come back so we can look at it. Lifting or chipping on gel or acrylic within the first few days of service will be corrected at no charge. Damage from impact, snagging or wear is a repair and is charged as one.

9Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of law rules. Any dispute arising out of these Terms, the website or services provided by Gaffey Nails & Spa will be brought in the state or federal courts located in Los Angeles County, California, and you consent to the jurisdiction of those courts.

If any provision of these Terms is found unenforceable, the rest remains in effect.

10Use of This Website

You agree not to use this site to transmit anything unlawful, to attempt to gain unauthorised access to it, to scrape it in bulk, or to interfere with its operation. Text, images, the logo and the layout of this site belong to Gaffey Nails & Spa and may not be reproduced without permission.

Service descriptions, timings and prices shown on this site are for general information. Final pricing depends on length, shape, art and condition of the natural nail, and is confirmed in the salon before work begins.

The site is provided on an as-is basis. To the fullest extent permitted by law, we are not liable for indirect or consequential losses arising from your use of it.
